Welcome to GPTour! The GPTour app is owned, developed, and operated by 10951811 Canada Inc. ("GPTour", "we", "us", or "the App"), a Canadian-based company. By using the GPTour app, you agree to be bound by these Terms and Conditions.

Please read these Terms and Conditions ("Terms") carefully before using the App. Your access and use of the App are conditioned on your acceptance of and compliance with these Terms. By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account and purchasing a tour through the App, you agree to these Terms. If you do not agree to these Terms, you should not use the App.

2. Account Creation and Security

To use the App, users must create an account using their Apple ID or Google account. The only information collected during this process will be the email associated with the respective account. It is your responsibility to keep your login details secure. We will not be liable for any loss or damage from your failure to comply with this security obligation.

3. Tour Purchases and Access

When you purchase a tour through the App, you gain permanent access to that tour across all available languages. This access is tied to your account and cannot be transferred. Purchased tours may also be accessed across devices by logging into your account.

4. Subscription Services (Phasing Out)

The App may offer a subscription service at a cost of $9.99/month, but this feature is being phased out. Subscription access allows users to access multiple tours while the subscription is active. Please note that this feature will no longer be available after a specified date, and users will retain access to tours purchased individually. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

5. Cancellation and Refund Policy

Users can cancel subscriptions anytime through their Apple ID or Google Play account settings. Please note, there are no refunds for unused portions of the subscription or for purchased tours.

6. Content Accuracy and Verification

The App provides guided audio tours generated by AI technologies such as ChatGPT. While AI-generated tours offer flexibility, their accuracy may vary. Some tours are written and verified by experts or qualified individuals, and these will be clearly indicated within the App. We recommend checking for this verification to identify human-authored content. We do not guarantee the accuracy, reliability, or completeness of AI-generated tours, and users should verify information independently if necessary.

7. Data Usage

Users should be aware that the usage of the App, particularly downloading and streaming audio files, may consume data. Users are responsible for any data charges incurred from their service providers due to the use of the App.

8. Third-party Services

The App utilizes third-party services such as MapKit, OpenStreetMap, and other APIs to find landmarks and provide additional information like images. We are not responsible for the content, privacy policies, or practices of any third-party services, and we advise users to read the terms and conditions and privacy policies of any third-party services that they visit.

9. Intellectual Property

All intellectual property rights in the App, its content, and the underlying technology are owned by us and/or our licensors. This includes, but is not limited to, tours, images, and audio content. No right, title, or interest in such intellectual property rights is transferred to you under these Terms.

10. Changes to these Terms

We reserve the right to modify these Terms at any time. We will inform you of any changes by posting the new Terms on this page. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App or its services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

13. Privacy Policy

Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of information as outlined in the Privacy Policy. Please review it carefully.

14. Location Services

The App may use your device's location services to provide location-based content and features, such as finding nearby landmarks and providing relevant tours. By using the App, you consent to the collection, use, and sharing of your location data for these purposes. You can disable location services at any time in your device settings, but this may limit the functionality of the App.

15. Indemnification

You agree to indemnify, defend, and hold harmless GPTour and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable legal fees and costs, arising out of or in any way connected with your access to or use of the App.

16. Age Restrictions

The App is intended for users who are at least 13 years old. By using the App, you represent and warrant that you are at least 13 years of age. If you are under the age of majority in your jurisdiction, you must have the permission of a parent or guardian to use the App.

GPTour expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
